These terms apply to consumer purchases made through maisongalerieboutique.com for delivery in the United States.

1. Seller

The seller is Tom Arcaro EI (entrepreneur individuel), a sole proprietor registered in France under the business name ARCARO TOM, trading as Maison Galerie.

2. Products

We take reasonable care to describe and photograph products accurately. Screen settings and manufacturing tolerances may cause minor differences in colour or finish. These differences do not affect your rights if a product is faulty or materially different from its description.

Product-specific materials, dimensions, electrical specifications and installation requirements are stated on the relevant product page.

Please review this information before ordering, particularly the voltage, frequency, connection type and installation requirements.

3. Prices and Taxes

Prices are displayed in US dollars (USD).

Before payment, checkout displays the total payable, including the goods, applicable shipping charges and any taxes we are required to collect. Applicable sales tax is shown at checkout.

As described in our Shipping Policy, we arrange for applicable import duties, customs charges and carrier import-handling fees to be covered so that customers do not pay additional import charges upon delivery.

If a carrier requests an unexpected import payment, contact us before paying so we can investigate and resolve the issue.

4. Orders and Contract Formation

Placing an order constitutes an offer to buy. An automated order acknowledgement confirms receipt of your order but does not, by itself, constitute acceptance.

The contract is formed when we expressly confirm acceptance or dispatch the goods, whichever occurs first.

Before acceptance, we may refuse or cancel an order if payment cannot be authorised, an item is unavailable, the price or description contains an obvious error, or fraud is reasonably suspected.

If we cancel an order, any payment collected for that order will be refunded in full. We will not increase an agreed price or substitute a materially different product without your agreement.

5. Payment

Available payment methods are displayed at checkout and may depend on your device, location and eligibility.

Payments are processed through Shopify’s checkout and the selected payment provider. We do not store complete payment card details.

6. Delivery

We currently deliver to the United States only. Orders are dispatched from China by our fulfilment partners.

Delivery charges, handling times, transit estimates, tracking and import arrangements are described in our Shipping Policy.

Our stated handling time is 1 business day, with an estimated carrier transit time of 2 to 8 business days. The total estimated delivery time is 3 to 9 business days, subject to the schedules and exceptions explained in that policy.

If we cannot dispatch an order within the promised time, we will notify you of the revised estimate and offer the option to accept the delay or cancel for a full refund, as required by applicable law.

7. Installation and Use

Follow the product instructions and applicable electrical safety requirements.

Hardwired lighting must be installed by a suitably qualified or licensed professional where required by local law. Verify that the product’s electrical specifications are compatible with the intended installation.

Do not install or use a product that appears damaged. Contact us if you identify damage, missing parts or a suspected fault.

These instructions do not limit our responsibility for defective, unsafe or misdescribed products under applicable law.

8. Cancellation, Returns and Refunds

Cancellation, return and refund conditions are detailed in our Returns and Refunds Policy.

We accept eligible change-of-mind return requests submitted within 30 days of delivery. Approved returns are sent to our return address in Mus, France.

For change-of-mind returns, the customer pays return shipping costs. We do not charge a restocking fee. Products that have been installed, hardwired, modified or damaged through misuse are not eligible for change-of-mind returns.

For faulty, damaged, incorrect or misdescribed products, contact us so we can arrange an appropriate remedy and cover reasonable return costs where a return is required.

Refunds are processed to the original payment method within 5 business days of receiving the returned goods, subject to any shorter deadline required by applicable law.

Nothing in these terms or our policies restricts mandatory consumer rights.

9. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, death or personal injury caused by negligence, or breaches of mandatory consumer rights.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase intended for personal consumer use.

Nothing in this section removes any remedy available to you under applicable law.

10. Governing Law and Disputes

These terms are governed by French law.

This choice of law does not deprive you of mandatory consumer protections available under the law that would otherwise apply, including applicable protections in your US state of residence.

You may bring proceedings before any court available to you under applicable law. These terms do not require exclusive proceedings in France.

If you have a complaint, please contact maisongalerieall@gmail.com so we can try to resolve it. Contacting us does not limit your right to pursue other available remedies.
